The IRS doesn't file lawsuits. They just seize your bank account, paycheck, etc and they don't do that until they've sent you plenty of notices that you have ignored.
They definitely do it by phone too. My mom unfortunately works for the IRS and its her job to call people and tell them this is their last warning before the government comes after them. :/
