So my gf has a doctors note for missing work today...they fired her for attendance when all of her absenses are doctors excused, is that even legal?

In an at-will state you can fire anyone for any reason, really.

I think possibly unless she was hurt on the job or documented disabled, then she might be able to raise a fuss but IANAL.

Unfortunately yes, some places don't care why you're absent just that you were. One of my old jobs didn't take doctor's notes, you got a point no matter the reason.

On the other hand, the reason I got fired wasn't because of the doctor's note portion of my absence, but the absences before that + the doctor's part. (I'd missed 6 days that six months and only 1 was a doctors note, and it happened to be my last one.)

edit: Old job you get 5 absences in a six month period, if

Yea well they also call her salary and don't pay overtime...then don't pay you for missing work. I told her she should sue them as that isn't legal at all.

Yeah that sounds like a whole load of not cool but probably barely legal tomfoolery. She should review them poorly on glass ceiling and then also contact the labor board about it.
