I've told her to talk to a lawyer, I live in Missouri and it does say that to be a salaried employee you are paid the same every week regardless of hours when looking into it which she was not..it also is a state that says OT must be paid at a time and a half rate.

I think she does have an argument.

Here is a decent page that goes over relevant law for exempt v. non-exempt employees re OT pay. There are a lot more facts I would want to know before taking a case like this but I would definitely advise her to talk to an employment attorney in Missouri.

If she does decide to do so, she'll have to be able to document the extra hours she worked above scheduled hours and prove them if she wants some money for the OT. That's probably all you can get unless there's more you haven't shared here about her termination.

So my gf has a doctors note for missing work today...they fired her for attendance when all of her absenses are doctors excused, is that even legal?
